their respective scope and limitations,
is necessary in order to determine
how to proceed.

When requesting services,
PLEASE take these steps first:

  1. Please contact Dr. Garber via email (not phone) so as to create a written record.
  2. Please do NOT share the facts or history of the particular matter so that Dr. Garber can maintain (every appearance of) impartiality.
  3. Please DO clarify the service you're seeking (that is, what role might Dr. Garber play)?
  4. Please DO provide demographics (for example: What state, county, and city are you in? How old are the children involved?)
  5. Please DO clarify whether Dr. Garber has ever been involved in this matter in any manner at any time.
  6. Please DO provide the court's case caption (for example, Smith v. Jones, NH 402-DM-2025-678) so that Dr. Garber can determine whether he has any conflict of interest.
  7. Please DO clarify the anticipated timeline (for example, when the next hearing or trial is scheduled) so that scheduling conflicts can be avoided.
With this information, Dr. Garber will advise whether he can provide the requested service, if so how best to proceed, and if not what other professionals might be available to do so.

Forensic family system evaluation (FSE)*

(also known as "child custody evaluation" or "parenting plan evaluation"; appointed by court; employed by parties)

  • Can be elective or court-ordered. This distinction bears on who determines what is evaluated and who receives the resulting report. (See graphic at left).
  • Interviews and/or observations and/or psychometric (tests) qualify individual social, emotional strengths and weaknesses.
  • Record review
  • Third party references
  • May include "parenting capacity" measures.
  • May generate individual mental health (DSM/ICD) diagnoses.
  • In some instances, parallel individual evaluations of each of two parents may be possible.

  • Does NOT directly assess parent-child or co-parent relationships.
  • Cannot generate relationship recommendations (e.g., custody)
  • May suggest likelihood of future acts but cannot predict the future.



Dr. Garber generally discourages
individual adult evaluation
and diagnosis
in the context of
family law proceedings as inefficient uses of time and dollars.

Regarding initial contact:
Communications via email are strongly preferred.
* Initial contact should be direct from the court, from the Guardian ad litem, or from both lawyers simultaneously (e.g., one email copy to all).

** The attorney initiating contact must NOT share his/her/their theory of the case. Initial contact is to determine Dr. Garber's qualifications and availability. Please clarify the questions before the court. Once Dr. Garber has reviewed preliminary data, a more in-depth conversation may be possible. Dr. Garber makes every effort to maintain impartiality.

*** Retaining attorney or firm owns Dr. Garber's record HOWEVER if retaining attorney/firm withdraws or is fired, Dr. Garber retains the discretion to share the record with successor counsel under specific conditions. Dr. Garber cannot provide this service to pro se (pro per) litigants.
